Florida Simple Divorce - The Facts

HOW CAN I HELP?

Through this website you can answer a few simple questions and a licensed attorney with over 22 years experience will draft all the documents needed to complete your divorce. There will be no hearings to attend and no need to travel. I will finalize your divorce and you will not have to leave your home.

This is absolutely no different procedure than you would experience if you made the trip to my office. It doesn't matter where in the state you reside.

Most divorce proceedings in the state are published in the local newspaper when they are filed with the clerk, through this service, your friends and neighbors will not have ready access to your business. Why? Because this will be published in the paper where the divorce is filed, not where you live. My office is in Collier County so obviously this does not apply to Collier residence.

WHO CAN THIS HELP?

Intelligent and reasonable people should be able to resolve their differences and part ways without having an emotional crisis and making their attorney rich in the process.

If you, and your husband or wife, have discussed your divorce and have no issues left that you disagree on, this service is for you. If you still have issues left unsettled try and talk them out. It is by far and away cheaper and easier to proceed as an uncontested divorce. If you simply can't agree, you should contact a local attorney near you. Divorce does not have to be financially and emotionally devastating. It does, however, have to be done properly.

It has been my experience that couples spend vast amounts of money fighting about an emotional issue. You need to evaluate what it is you're really fighting about and is it really worth it financially. Keep in mind that in a contested divorce many attorneys will be billing at around $200.00 per hour for each hour they work for you. Is that $150.00 couch really worth it. Once a couple decides to get divorced from a practical standpoint emotions should not play a part in the settlement. I believe that is the hardest thing for couples to understand because emotions surrounding the failed "relationship" are almost always raw during the divorce process.

HOW MUCH WILL IT COST?

If all paperwork is signed as drafted by both parties and returned to my office, the prices listed below are the total cost of your divorce. There are no hidden costs or fees. The only time there would be additional fees is if both parties decide they want changes made to the documents. If changes are requested, there will be a $75.00 re-draft fee to make the change. Obviously if the change is necessary due to a drafting error on my part, there would be no charge.

Many times couples who have been married for a short time, who have been separated for a long time, or for whatever other reasons have no minor children, own no property together or have joint debts like credit cards or other loans. This is by far the easiest, cheapest and least time consuming situation in which a divorce can be accomplished.

Couples can be divorced in approximately 30 days assuming all parties sign the documents drafted for them and return them to my office promptly. The courts will not look at a Divorce file until at least (20) twenty days have past since it is filed with the clerk of courts.

If both parties sign the documents and there are no changes requested by either party, the cost listed is your total cost.

If the parties change their mind after the documents are drafted, and the attorney is requested to make changes there will be a $50.00 charge to redraft the document with the changes. Sometimes individuals will request additional services not contemplated in the divorce. These will be discussed as they arise.

Divorces that have children in all counties require the parties to attend a "Child First" program. This teaches parents how to deal properly with the issues facing their relationship with their children. I firmly recommend this regardless of the requirement. Our children's needs are far to often overlooked during this time. There are similar programs in almost every county in Florida. You will need to attend and obtain a certificate of completion prior to the divorce being finalized. There is usually a fee for this service but that will vary by location. I will provide you with the options for your area when I respond to your request.

HOW DO I PAY?

My requirement is that you at least pay the cost of drafting the documents up front, but you also have the option of paying the total cost including the filing fee. Payment can be made by Credit Card using our Online Secure Payment System or you may send a check by U.S. Mail to the address listed below. When I send you the documents for signing, if you did not include payment for the filing fees in your initial payment you will return them with the $408.00 filing fee with a check made out to the Clerk of Courts or again you also have the option of paying by Credit Card using our Online Secure Payment System.

HOW LONG WILL IT TAKE?

The court can sign your final judgment of dissolution after waiting twenty days from the date the papers are filed. Sometimes persons with children who have to attend the "CHILD FIRST" class will need more time due to scheduling conflicts. My office will file the papers when they are completed and returned to me. As a general rule of thumb the divorce will be completed within thirty days of filing.

My personal goal is to have your paperwork completed and in the mail to you within 48 hours of receiving your request. I will do everything I can to complete this process as quickly and painlessly as possible. Usually the judges will sign off on the Final judgment within 2 or 3 days of receiving it.
