Simple Divorce Involving Debts Client Information - Home


Many times couples, for whatever reasons, have no minor children, but they do own property together or have joint debts like credit cards or other loans.  This can also be an easy inexpensive and situation in which a divorce can be accomplished.

Couples can be divorced in approximately 30 days assuming all parties sign the documents drafted for them and return them to my office promptly.  The courts will not look at a Divorce file until at least (20) twenty days have past since it is filed with the clerk of courts. 

There are no hearings for you to attend.  All the paperwork needed will be drafted and sent to you for signing.  My office takes care of the rest until the divorce is finalized.  

FEES AND COSTS

To pay the filing fee of $408 online, the charge is $420 because of the credit card fees I get charged. Otherwise please make a check payable to Philip Darnell for the $408 which you can mail back with your signed documents.

If all paperwork is signed as drafted by both parties and returned to my office, this is the total cost of your divorce.  There are no hidden costs or fees.  The only time there would be additional fees is if both parties decide they want changes made to the documents.  If changes are requested, there will be a $50.00 re-draft fee to make the change. Obviously if the change is necessary due to a drafting error on my part, there would be no charge.

  13. Do you own any automobiles jointly, and if so what do you want to do with them? Who will keep and be responsible for each vehicle (repayment of loans, taxes, maintenance), for example. If they are to be sold, who will get the proceeds and if split how will it be split? 


  14. Do you have any jointly held Credit Cards, and if so what do you want to do with them? Who will pay them off? 

    Note: You DO NOT have the right to divorce away the third parties right to repayment. If your name is on the card, you will remain responsible until the debt is paid or the credit card company releases you from the debt. One party can agree to pay the debt but if they default the credit card company may still come after the original responsible party for repayment. The the original responsible party would have to take the defaulting party to court to force payment.


  15. List all other debts or loans. Include the name of the creditor along with the amount of the debt(s) and who will pay the debt(s).


  16. List all specific personal property you may still need to divide. Please be specific as to who the property will go to.
